It's actually much more complex than that, so this just as a comment and not an entry suggestion:
There are three entities in a German criminal offense evaluation:
A: Tatbestand = the objective and subjective elements of the offense,
B: Rechtswidrigkeit =  unlawfulness, wrongfulness or illegality, and
C: Schuld = culpability / guilt.
The term Straftatbestand in its strictest sense is used to mean A. But (and this is where the complexity starts) it is also used in a wider sense to mean the combination of A and B. If it is used to mean AB, one can argue that Straftatbestand means "offense" and by implication, must then include C as well.

MichaelK, this is very useful information, I'll copy and save this (as I remember that I used to struggle with these terms myself not too long ago).
Fritzla: It may be easier if you just give us the paragraph which you need translated. For example, in a MAR (mutual assistance request = Rechtshilfeersuchen) it can be simply the "Background" or the "Facts of the Case".
On the other hand, if you are translating laws or legal regulations you would start with, "A person who ...", and finish with "commits an offence" or alike.
By which I mean to say that I have not come across a 1:1 translation of "Straftatbestand" yet.

Sprachgebrauch: Eine bestimmte PERSON hat den Tatbestand (des Diebstahls, des Raubes etc.) erfüllt  Für eine Bestrafung müssen noch Rechtswidrigkeit und Schuld gesondert festgestellt werden.

Straftatbestand. = statutory offence, i.e a description of human demeanour that should be punished.
Sprachgebrauch: Eine bestimmte HANDLUNG oder ein bestimmtes VERHALTEN erfüllt den Tatbestand (des Diebstahls, des Raubes etc). Das ist eine abstrakte Beschreibung, von bestimmten Personen ist nicht die Rede!

So wie ich das vor vielen, vielen Jahren gelernt habe, ist das, was im Gesetz steht, der "Tatbestand" und das, was de facto passiert ist, der "Sachverhalt", der unter den Tatbestand subsummiert wird, d.h. der Richter prüft und entscheidet letztendlich, ob der der Sachverhalt den Tatbestand - ggfls. samt seiner einzelnen "Tatbestandsmerkmale" - erfüllt.
